Terms and Conditions

  1. Seller
    leselles bv has its registered office at 9450 Denderhoutem and is registered in the Crossroads Bank for Enterprises (CBE) under number 0692.515.662 and the VAT number is BE0692.515.662

  2. Application
    Each order is deemed to constitute acceptance by the Buyer of our general terms and conditions, which form an integral part of the agreement, to the exclusion of all other general or special terms and conditions issued by the Buyer, unless expressly agreed otherwise in writing.

  3. Quotes, orders and vouchers
    All our offers are without obligation. We are only bound by an order after we have confirmed it in writing or after we have started with the execution. The information about the products and the pricing, as well as the detailed order information, are drawn up and communicated subject to change and correction.
    Vouchers are valid for 6 months after purchase.

  4. Delivery
    Products are only delivered in the countries for which the website permits delivery. The delivery of products will, to the extent possible, take place within the time specified in the individual order confirmation. Incorrectly specified delivery addresses are the responsibility of the Buyer and may result in additional costs. Unless otherwise agreed, our prices do not include the transport and delivery of the goods to the Buyer. The costs of transport and delivery are stated separately. The stated delivery times are not binding, but are given for information purposes only. No delay in delivery can give rise to termination of the purchase or payment of damages in favor of the Buyer, except in the case of intentional delay. We are entitled to make partial deliveries. In the event of non-delivery of the goods, any sums paid by the Buyer will be refunded without interest or other compensation.

  5. Complaints
    In order to be admissible, complaints must reach us: (a) in the case of a complaint due to non-conforming delivery, eight (8) days after delivery and (b) in the case of hidden defects, eight (8) days after discovery of the defect or after the moment at which such discovery could reasonably have occurred. The receipt of the goods by the Buyer covers any possible defect or non-conformity that could then be established.

  6. Guarantee
    Our warranty is limited to the warranty for hidden defects and the warranty in case of consumer purchase, both provided for in the Civil Code. We are only responsible for damage that is the result of intent or gross negligence. We are not liable for general or special indirect damage, of whatever nature, suffered by the Buyer.

  7. Right of withdrawal - Returns
    In the context of distance selling to consumers who fall within the scope of the Law of 6 April 2010, the consumer has the right to inform the seller that he is cancelling the purchase, without payment of a fine and without giving reasons within 14 calendar days from the day following the order. If the consumer invokes this possibility, he must return the goods in their original condition and packaging to leselles BV at his own risk and expense. Goods that have been ordered specifically for the Buyer will not be taken back and the Buyer can therefore not invoke the renunciation clause. Returns by cash on delivery will not be accepted. The refund will be made to the account number specified by you after receipt and inspection of the return. Items with discounts cannot be exchanged or refunded.
    If samples are sold online at discounts, they cannot be returned or exchanged. Items with discounts cannot be exchanged or refunded.

  8. Force majeur
    We shall not be liable for any delay in the performance or for any non-performance of our obligations due to events beyond our normal control, including production interruptions, difficulties in the supply or shortages of raw materials, labour, energy or transport or delays in transport, strikes, lock-outs, work stoppages or other collective labour disputes, which affect either ourselves or our suppliers, even if these events are foreseeable.

  9. Payment
    We accept the following secure online payment methods via Mollie: iDeal, MasterCard, Visa, Bancontact / Mister Cash, Belfius & KBC. Invoices are payable at our registered office at 9450 Denderhoutem on the due date, net without discount, unless otherwise stated on the invoice. Any complaint regarding invoices must, in order to be admissible, be formulated in detail by registered letter within three (3) days of receipt of the invoice. In the event of late payment, interest will be charged on the outstanding invoice amounts by operation of law and without any prior notice of default being required, at a rate of 1% per month from the invoice date. In the event of non-payment and if a reminder by ordinary letter has remained unanswered for 14 days, a fixed compensation will also be due amounting to 10% of the outstanding amounts.

    We reserve the right, in the event of any total or partial non-payment of an invoice on the due date or any other breach by the Buyer of its obligations under the agreement, to suspend the performance of all agreements with the Buyer or to terminate them with immediate effect, by operation of law and without notice of default, without the need for any judicial intervention and to immediately claim all debts, even those not yet due, or to carry out the delivery only against cash payment, notwithstanding previous agreements and without prejudice to any other right that we may assert. Failure to take immediate action against a shortcoming by the Buyer can in no case be considered as a waiver on our part to invoke this shortcoming later.

  10. Personal data
    By ordering on the internet site leselles, the Buyer expressly agrees to the processing and use of his/her personal data for purposes such as the administration of the customer database, the management of orders, deliveries and invoices, the monitoring of solvency, marketing and advertising. The processing for marketing purposes and the individualized advertising only takes place if the customer has expressly agreed to this during the order process. LesElles may not transfer the data to third parties. The Buyer has the right to inspect and correct all data. The Buyer has the right at all times to object free of charge to the processing for direct marketing purposes. For more information, the Buyer is invited to contact the public register kept by the Commission for the Protection of Privacy in Brussels.

  11. Cookies
    Our website uses cookies, which can place `cookies` on the hard drive of your computer during a visit to our site.     Our website, logos, texts, photos, names and in general all our communication are protected by intellectual property rights that are either ours or our suppliers or other rights holders. It is prohibited to use and/or make changes to the intellectual property rights as described in this article. For example, you may not copy or reproduce drawings, photos, names, texts, logos, color combinations, etc. without our prior and express written permission.

  13. Proof
    All Parties accept electronic evidence within the framework of their relations (for example: e-mail, backups, ...).

  14. Severability
    If any article of these terms and conditions is declared null and void, such nullity shall not affect the validity of the remaining articles.

  15. Applicable law
    All agreements concluded with Seller are governed by Belgian law. The Belgian courts have exclusive jurisdiction.
